What you buy when you pay for virtual currency or items in a game that uses Apilow GameCoin, who sells it to you, and your rights.

1. Who sells, and who these terms apply to

When you buy virtual currency ("coins"), a pack or items in a game that uses Apilow GameCoin, the seller is Apilow (Rucquoy Edouard, entrepreneur individuel (Apilow), [À COMPLÉTER], company and VAT number BE 1041.489.691, contact: contact@apilow.com), hereafter "Apilow" or "we".

Apilow sells this content in its own name (Merchant of Record). The studio that publishes the game ("the studio") designs the game, decides what coins can do in it and hosts you there; it is not the seller. Apilow invoices you, collects VAT, sends you the receipt and handles refunds.

These terms apply to every order placed on an Apilow GameCoin payment page. They complement the game's own rules set by the studio (terms of use of the game, code of conduct), which govern how you play. Where they conflict on the sale itself, these terms prevail.

2. What you buy

  • Digital content. Coins and items are digital content delivered to your game account. They are not money, have no monetary value and are neither electronic money nor a payment instrument.
  • A right to use, not ownership. You receive a personal, non-exclusive, non-transferable licence to use the coins and items in the game concerned, for as long as the game and your account exist, in accordance with the studio's rules.
  • Never convertible. Coins cannot be exchanged for money, transferred to another player or used in another game. A balance cannot be sold or assigned. Apilow offers no betting, no tournaments with stakes and no paid chests with random content.
  • Free coins and paid coins. The studio may give you coins (bonuses, events, referrals). The ledger keeps free coins apart from paid coins; free coins are generally spent first. Only paid coins can be refunded.

3. Who may buy

  • You must be 18 or older, or have the consent of the person holding parental authority. A parent or guardian can pay for a minor through the "ask a parent" feature when the game offers it; they then accept these terms on the minor's behalf.
  • You buy for your own personal use in the game, not for resale.
  • At launch, Apilow sells to people residing in the European Union. The country you state at purchase is used to calculate VAT; it must be the country where you usually live.

4. Order, prices and payment

  • Offers (packs, items) and their prices are set by the studio and shown on the payment page inclusive of all taxes, in euros. The VAT rate is that of your country of residence. The breakdown (net amount, VAT, total) is shown before you pay.
  • The order is concluded when you click "Pay" after reading the summary and ticking the immediate delivery box (section 5). Payment is processed by our payment provider (Stripe); Apilow neither sees nor stores your card number.
  • An unpaid order expires after the time shown on the page. A receipt is e-mailed to you and remains available from the receipt link. In a game's test environment, payment is simulated and no money is charged: the receipt says so.
  • Prices may change at any time for future orders; the price shown when you pay is the price you are charged.

5. Immediate delivery and right of withdrawal

Coins and items are delivered immediately after the payment is confirmed, to your game account.

As a consumer you normally have a 14-day right of withdrawal. For digital content supplied without a physical medium, this right is lost as soon as delivery begins, provided you expressly requested this immediate delivery and acknowledged losing your right of withdrawal (Belgian Code of Economic Law, article VI.53, 13°; Directive 2011/83/EU, article 16(m)). This is why the payment page asks you to tick this box before paying: without your consent, no payment is opened. The version of the text you accepted is stored with your order and recalled on the receipt.

6. Refunds and disputes

  • Delivery error. If the coins or items you paid for are not delivered, or do not match what was described, write to us (contact@apilow.com) or contact the studio: we deliver what is missing or refund you.
  • Goodwill. If you ask within 14 days of the purchase and none of the pack's coins have been spent, Apilow refunds the order without asking why. Later, or if part has been spent, Apilow reviews the request case by case.
  • Effect of a refund. Refunded coins and items are removed from your account. If you had already spent them, your balance in the game may become negative until it is made up, depending on the setting chosen by the studio.
  • Chargebacks. Before disputing a payment with your bank, contact us: most situations are settled within days. An abusive dispute (a purchase you made and then contested) may lead to your purchases being suspended in games that use Apilow GameCoin.
  • A refund is made to the payment method used for the purchase, within 14 days of our decision. A credit note is sent to you.

You benefit from the legal guarantee of conformity for digital content and services (Belgian Civil Code, book 3, title 4, chapter 1/1; Directive (EU) 2019/770). If purchased content is not in conformity (not delivered, unusable because of a platform defect), you may demand that it be brought into conformity and, failing that, a price reduction or a refund. This guarantee does not cover changes to the game's rules decided by the studio (section 8), nor problems specific to your device or connection.

8. The game, how it changes and how it ends

  • The studio remains in charge of its game: it may change items, their effects, the balancing, and add or remove offers. What coins can obtain may therefore change. Apilow is responsible only for the sale, for keeping the ledger of balances and for delivery into the ledger, not for the content of the game.
  • If the studio closes the game or stops using Apilow GameCoin, Apilow informs you (through the studio, by e-mail if we have your address, or on the payment page) at least 30 days in advance when possible. Unspent paid coins bought in the 30 days before that announcement are refunded by Apilow on request. Older coins, free coins and items are not refunded.
  • The studio may close your game account under its own rules (cheating, fraud, prohibited behaviour). The coins and items it contains are then lost, unless the studio's rules say otherwise.

9. What you agree not to do

You must not: use a payment method that is not yours; obtain coins through a flaw, a bot or an abuse of a promotion; dispute a payment you actually made; resell, exchange or transfer coins or items; use the platform to launder money. In case of proven fraud, Apilow may cancel the orders concerned, remove the corresponding coins and items, and refuse your future purchases in the games it serves; sums paid through fraud are not refunded.

10. Liability

Apilow uses reasonable means to keep the payment page and the ledger of balances available and accurate. Apilow is not responsible for the operation of the game, its content or the studio's use of coins. Except for personal injury, gross negligence or wilful misconduct, Apilow's liability towards you is limited to the amount of the orders concerned. Nothing in these terms reduces the rights the law gives you as a consumer.

11. Personal data

Apilow processes your data to sell, invoice, deliver, prevent fraud and meet its tax obligations. The studio processes your game data. Everything is explained in our privacy policy.

12. Complaints, mediation and applicable law

  • For any question or complaint: contact@apilow.com. We answer within 10 working days.
  • If we cannot find a solution, you may refer the matter free of charge to the Belgian Consumer Mediation Service (Service de Médiation pour le Consommateur, North Gate II, Boulevard du Roi Albert II 8 bte 1, 1000 Bruxelles, Belgique, https://mediationconsommateur.be) or to the alternative dispute resolution body competent in your country.
  • These terms are governed by Belgian law. If you live in another European Union country, you keep the protection of the mandatory rules of your country of residence. The competent courts are those designated by law; for a consumer, these are in principle the courts of their place of residence.

13. Changes

Apilow may change these terms for future orders. The version applying to an order is the one shown at the time of payment; its date appears at the top of this page. Significant changes are announced on the payment page.
